WAIVER, RELEASE, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENTCharlotte’s Spot LLC d/b/a The Village Play CaféMontgomery, Texas
PLEASE READ CAREFULLY. This is a legally binding agreement that impacts your rights. By signing, you acknowledge that you have read and understood this document and agree to the terms below.
In consideration for being permitted to enter and participate in activities at The Village Play Café, I, on behalf of myself and any minor child or children under my care, agree as follows:
• The Village Play Café is a boutique indoor play café designed for young children and their caregivers. The space includes wooden role play structures known as Tiny Town, small elevated play features, slides, soft play elements, a contained circular jumping feature, open play sessions, private celebrations, enrichment classes, café seating areas, retail merchandise, and a coffee bar.
• This Facility is not a childcare or drop off service.
• I understand that I must remain on the premises at all times and actively supervise my child or children.
• I accept full responsibility for monitoring my child’s behavior, actions, and whereabouts while inside the Facility.
• Staff members provide general oversight of the space but do not supervise individual children.
• Grip socks are required for children in all play areas.
• Socks are required for adults entering play areas.
• Shoes are not permitted in play areas for any guest.
• I understand that failure to follow footwear policies increases the risk of slipping or falling.
• Guests are welcome to bring personal water bottles into the Facility.
• Outside food and beverages, other than water, are not permitted except during pre booked private parties in designated party areas.
• Food and beverages purchased from The Village Play Café may be consumed in designated seating areas.
• No food or beverages of any kind, including water, are permitted in active play areas.
• I understand that bringing food or beverages into play areas increases the risk of choking, slipping, contamination of shared equipment, and injury.
• The circular jumping feature allows multiple children to bounce at the same time. I understand that when several children use a jumping surface simultaneously, movement by one child may affect the balance or landing of another.
• I acknowledge that participation in active play, including climbing, balancing, sliding, and bouncing, may involve risks including slips, trips, falls, collisions with other children, loss of balance, improper landings, twisting of ankles or knees, contact with surrounding structures, minor equipment malfunction, choking hazards, exposure to common illnesses, and loss or theft of personal belongings.
• I understand that active children’s play naturally involves movement, unpredictability, and shared space.
• I voluntarily and knowingly assume all risks associated with entry into the Facility and participation in activities.
• I confirm that neither I nor my child or children are experiencing symptoms of illness at the time of entry and understand that exposure to viruses or communicable illness may occur in any public setting.
• The Village Play Café is not responsible for lost, stolen, or damaged personal property.
• I agree to be financially responsible for any damage caused by myself or my child or children beyond normal wear and tear.
• In the event of an emergency, I authorize staff to seek appropriate medical assistance and agree to assume any associated costs.
• I agree to follow all posted rules and verbal instructions provided by The Village Play Café.
• I understand that failure to comply with Facility policies, including supervision, footwear, food and beverage, safety, or conduct expectations, may result in removal from the Facility without refund.
TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, I HEREBY RELEASE, WAIVE, AND AGREE NOT TO SUE CHARLOTTE’S SPOT LLC D/B/A THE VILLAGE PLAY CAFÉ, ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, LANDLORD, PROPERTY OWNER, MANAGEMENT COMPANY, AFFILIATES, SUCCESSORS, ASSIGNS, AND INSURERS FROM ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO ENTRY INTO THE FACILITY OR PARTICIPATION IN ACTIVITIES, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.
I AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS THE RELEASED PARTIES FROM CLAIMS ARISING FROM MY OR MY CHILD’S ACTIONS, FAILURE TO SUPERVISE, OR VIOLATION OF FACILITY POLICIES, INCLUDING ASSOCIATED LEGAL COSTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, I WAIVE ANY CLAIM FOR PUNITIVE, EXEMPLARY, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES.
I agree that any dispute must first be submitted to mediation in Montgomery County, Texas prior to filing suit. I knowingly and voluntarily waive the right to a trial by jury. I agree that any claim must be brought individually and not as part of a class, collective, or representative action.
This Agreement is governed by Texas law. Venue for any permitted litigation shall lie exclusively in Montgomery County, Texas.
This Agreement applies to all current and future visits unless replaced by an updated waiver issued by The Village Play Café, which reserves the right to revise this agreement at any time and require re execution.
By signing below, I acknowledge that I have read and understand this Agreement, understand that I am releasing certain legal rights, and sign voluntarily.
